O R D E R

The case of the petitioner is that he made representation before the 3rd respondent - Tahsildar, to delete the subject land from the dispute register, as the suit filed by him in O.S.No.92 of 2016 on the file of Senior Civil Judge Court at Adone, ended in compromise by way of Award dated 24.11.2018 passed by Lok Adalat. But the 3rd respondent, without taking into consideration the award passed by Lok Adalat, made the impugned endorsement in R(B).C.683/2016 dated 28.11.2018, stating that as and when final judgment in rendered in the suit in O.S.No.92 of 2016, the same will be intimated to the Higher Officials and action will be taken. Aggrieved by the said endorsement, the present writ petition is filed. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

When the case of the petitioner is that the suit filed by him in O.S.No.92 of 2016 on the file of Senior Civil Judge at Adone, was disposed of in view of the compromise entered into between the parties and the same was recorded in the award passed by Lok Adalat dated 24.11.2018, the impugned endorsement of the 3rd respondent stating that action be taken after final judgment in the suit, is without application of mind. Hence, the impugned endorsement is set aside and the 3rd respondent is directed to reconsider the representation made by the petitioner for deletion of the subject land from the dispute register, by taking into consideration the award passed by Lok Adalat dated 24.11.2018.

The writ petition is accordingly allowed to the extent indicated above. Interlocutory applications pending, if any, shall stand closed. No costs.
