Heard learned counsel for the petitioners, learned Government Pleader for Panchayat Raj for respondents 1 to 4 and Sri K.K.Durga Prasad, learned Standing counsel for respondent No.5.

Petitioners claim to be the residents of Pandalapaka Village, Biccavolu Mandal, East Godavari District. Petitioners allege that respondents are initiating steps to construct Anganwadi Centre, on the bund of public tank i.e., Uurva Cheruvu in R.S.No.251, and such proposal to construct Anganwadi Centre, is without following the due procedure, without there being a resolution by the Gram Panchayat and such construction may cause danger to the children as the Centre is proposed to be located on the Bund. 3.

Learned Standing counsel, on instructions, submits that no decision is taken to locate Anganwadi Centre. Five places were identified including the said premises. But so far no final decision is taken by the Gram Panchayat. Unless and until a decision is taken by the Gram Panchayat, further steps will not be taken for construction of Anganwadi Centre. 4.

The instructions furnished to learned Standing counsel, as noted above, would show that even before a decision is taken, and only on apprehension, this writ petition is filed.
