THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6373 of 2016 ORDER:
Heard Sri Srikanth Hariharan, learned counsel for the petitioner, and Sri Chatla Madhu, learned Standing Counsel for the Greater Hyderabad Municipal Corporation.
The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a writ, order or direction, more in the nature of Writ of Mandamus declaring the notice of demand in Notice No. Cir-18/2015-16 in Sl. No. 2134 dated 19.02.2016 issued by the Respondent No.2 in mechanical manner demanding huge amounts as property tax for the premises bearing no.
3-2-76 & 282 to 283, General Bazar, Secunderabad in occupation of Petitioner without any rhyme or reason and arbitrarily contra to GHMC Act as wholly illegal, irrational and contrary to the provisions of Constitution of India and consequently set aside the same by directing the Respondents to reconcile and receive the actual amount of property tax due from petitioner and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case." It appears that the petitioner's representation dated 11.01.2016 in relation to his grievance about the quantification of the tax is still pending consideration before the municipal authorities.
In that view of the matter, the writ petition is disposed of directing the Commissioner, Greater Hyderabad Municipal Corporation, to consider the said representation dated 11.01.2016 under Section 221 of the Greater Hyderabad Municipal Corporation Act, 1955, and take appropriate action thereon in accordance with law. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
