HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 5259 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not according permission/approval to fill up the existing vacancies of teacher posts in the petitioner school, as illegal and arbitrary. A consequential direction is also sought to the respondents to permit the petitioner school to fill up three teacher posts.

Heard Sri J. Pardhasaradhi, learned counsel for the petitioner, and learned Government Pleader for Education appearing on behalf of the respondents.

It has been contended by the petitioner that it is one of the established schools in Guntur District and three posts of teacher have fallen vacant, and that the management of the petitioner school had submitted proposals seeking permission to fill up the said vacant posts, but the respondents have not passed any orders. This Court having considered the said contention is of the considered view that the writ petition can be disposed of directing the petitioner school to submit a representation afresh to the respondents. Accordingly, the writ petition is disposed of directing the petitioner school to submit a representation afresh to the respondents seeking permission to fill up the vacant posts, within one week from the date of receipt of a copy of this order, and upon receiving such

representation, the respondents shall consider and pass appropriate orders within four weeks thereafter.
