THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22016 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Roads and Buildings. With their consent, the present Writ Petition is disposed of at the admission stage.

2. Since this Court is not adjudicating the matter on merits, hearing of the unofficial respondent may not be necessary.

3. The present Writ Petition is filed with the following prayer: "to issue an Order, Direction or Writ, more particularly one in the nature of Writ of Mandamus, declaring the action of the official respondents in not considering the representation dated 14.03.2016 made by the petitioner for demolition of illegal structure raised by 5th respondent and to restore the village road to its original standard, as illegal, arbitrary and against the settled principles of law, in violation of provisions of Grampanchayat Act and consequently direct the official respondents to consider the representation dated 14.03.2016 and take necessary action."

4. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the 2nd respondent to consider the representation dated 14.03.2016 made by the petitioner at the earliest.

5. Learned Government Pleader for Roads and Buildings submits that the appropriate authority to take steps in respect of relief sought by the petitioner is the Grampanchayat -Respondent No.6 and not the District Collector-Respondent No.2.

6. Having regard to the above, the Writ Petition is disposed of

directing the petitioner to make a fresh representation before the 6th respondent within a period of one week from today, in which event the same shall be dealt with, in accordance with law, as early as possible preferably within a period of three (03) weeks thereafter, after giving an opportunity of personal hearing to the deponent herein.
