The present writ petition came to be filed seeking the following relief:

"to issue a writ, order or direction, particularly one in the nature of writ of mandamus, declaring the action of the respondent No.2 in not laying drain pipe line and manhole in front petitioner house bearing H.No.2-8124/S/25 over Plot No.25 part and Plot No.26 in Survey Nos.5 and subdivided No.5/a,aa,3,33,u, 81/a,aa,e,ee,u admeasuring 244.44 sq.yds situated at Bharathnagar Colony, Uppal village, R.R. district as unjust, arbitrary, unconstitutional and consequently direct the respondent to lay drain pipe line and manhole in front of petitioner house bearing H.No.2-8-124/S/25 over plot No.25 part and plot No.26 in Survey No.5 and subdivided No.5/a,aa,e,ee,u, 81/a,aa,e,ee,u admeasuring 244.44 sq.yds situated at Bharathnagar Colony, Uppal village, R.R. district".

The petitioner who is residing in a house bearing H.No.2-8124/S/25 over Plot No.25 part and Plot No.26 in Survey Nos.5 and 81 subdivided No.5/a,aa,3,33,u, 81/a,aa,e,ee,u admeasuring 244.44 sq.yds situated at Bharathnagar Colony, Uppal village, preferred this writ petition, questioning the action of the authorities in not laying the storm water drain, as illegal and incorrect. It is stated that the house of the petitioner is located as last house plot of internal road, in the lay out abutting small open space. Few years back, the 2nd respondent carried underground drain work in that street and laid drain pipeline starting from the plot adjacent to the plot of the

petitioner. The said pipeline was said to have been laid without following the required norms. Her grievance appears to be that instead of laying a manhole in front of her house, the same was laid in front of Plot No.2-8-124/S/24, for the benefit of the said person. It is his case that there is no proper flow of drain water from his house to the existing manhole, which is in front of Plot No.2-8-124/S/24, as a result of which, water is getting blocked in front of his house, leading to health hazards.

Mr.Sampath Prabhakar Reddy, learned Standing Counsel for GHMC, on instructions would state that if reasonable time is granted, definitely authorities would take steps for realignment of the drain. 4.

Having regard to the submissions made, the writ petition is disposed of, directing the 2nd and 3rd respondents to take steps for laying a storm water drain, so as to prevent clogging of water in the said locality, including in front to the house of the petitioner, as early as possible, within a period of three months. 5.
