O R D E R

The case of the petitioner is that aggrieved by the proceedings in Roc B/143/2013 dated 22.10.2018 issued by the 3rd respondent - Tahsildar, in rejecting his request for regularization of subject under Section 3(5) of A. P. Assigned Lands (Prohibition of Transfers) Act, 1977, he file appeal before the 2nd respondent - Revenue Divisional Officer under Sections 4(1) and 4-A of the said Act on 05.11.2018, along with application seeking for interim stay of the proceedings of the 3rd respondent dated 22.10.2018. His grievance is that 2nd respondent is not passing any orders in the interim stay application filed by him, and in the meanwhile, the 3rd respondent is taking steps to evict him from the subject land. Hence the writ petition.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

Having regard to the facts and circumstances of the case, writ petition is disposed of directing the 2nd respondent to dispose of the appeal filed by the petitioner in accordance with law, after giving opportunity to the petitioner and other effected parties, if any. Till the disposal of the appeal, petitioner shall not be dispossessed from the subject land.
