HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35613 of 2016 ORDER:

This writ petition is filed seeking to call for the records pertaining to Crime No.264 of 2016 of Nandyal Taluk Police Station, Kurnool District and consequently to quash all further proceedings.

Heard and perused the material available on record. The case of the petitioner is that the petitioner is working as a Senior Assistant in the office of the Superintendent Engineer, Water Sources Department, Government of Andhra Pradesh, since 21 years and that a private complaint was filed by the 4th respondent before the learned Judicial Magistrate of First Class, Nandyal, on 31.08.2016, which was referred to the respondent police under Section 156(3) Cr.P.C. and the same has been registered as Crime No.264 of 2016, on the file of Nandyal Taluk Police Station, Kurnool District, under Sections 468, 471, 420 read with 34 IPC.

The main grievance of the petitioner is that the petitioner has not taken any money nor promised to secure a job and the alleged incident took place in the year 2012 and the 4th respondent has filed a private complaint four years thereafter and that there is a threat of arrest from the respondent police. Learned counsel for the petitioner submitted that the petitioner has nothing to do with the alleged offences or transactions and that all the transactions took place at Nandyal and the petitioner has been working at Kadapa since 2009 and therefore, the question of involvement of the petitioner in the above crime does not arise.

Considering the grievance of the petitioner and the submission of the learned counsel for the petitioner, the 3rd respondent is directed to complete the investigation in Crime No.264 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, within a period of six (6) months from today without arresting the petitioner. The petitioner is directed to appear before the 3rd respondent as and when required for the purpose of investigation.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO, J Date: 21st October, 2016 KL
