HON'BLE SRI JUSTICE Dr. B. SIVA SANKARA RAO CIVIL REVISION PETITION No.6523 of 2017 ORDER:

Heard both sides and perused the grounds urged in the revision and the impugned docket order of the lower Court dated 02.11.2017.

The very summons through Court returned as out of availability and the Court at best should have been issued hand summons to secure the witness by the defendants instead of closing the evidence of the witness.

Having regard to the above, the Civil Revision Petition is allowed by directing the trial Court to issue, immediately after receipt of this order, hand summons to the witness to cause serve by the defendants and to secure the witness within one week from the date of issuance of the summons and to complete the evidence as early as possible to proceed further with the matter. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
