HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.44098 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the 2nd respondent in not considering the representation dated 22.11.2018, submitted by the petitioner seeking to take action against the illegal constructions made by the 3rd respondent in Sy.No.441 of Nampalley Village, Vemulawada Municipality Limits, adjacent to the plot of petitioner, contrary to the sanctioned plan and without leaving set backs, as illegal and arbitrary.
Learned counsel for the petitioner submits that though the petitioner submitted a representation to the 2nd respondent on 22.11.2018, seeking to take action against the illegal constructions made by the 3rd respondent over the subject premises, no action has been taken so far.
The learned Standing Counsel for the 2nd respondent, would submit that the respondent-authorities may be directed to pass appropriate orders on the representation of the petitioner, in accordance with law, at the earliest.
Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondent, to deal with the representation dated 22.11.2018, submitted by the petitioner seeking to take action against the illegal constructions made by the 3rd respondent over the subject premises, and pass appropriate orders, in accordance with law as early as possible, preferably within a period of three to four weeks from the date of receipt of copy of this order by giving reasonable opportunity of hearing to the petitioner and all concerned. No order as to costs.
As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
