When the matter is taken up, the written instructions furnished by the Inspector of Police and Station House Officer, Machavaram Police Station, Vijayawada City, dated 11.12.2018, are placed on record by the learned Government Pleader. The said instructions read as under: It is submitted that basing on the complaint of the petitioner, a case in Crime No.174 of 2016, dated 02.04.2016 under Section 419, 468 IPC was registered on the file of the Machavaram Police Station, against the 4th respondent herein and taken up investigation. It is submitted that during the course of investigation, the investigation officer has examined (6) witnesses and recorded their statements. Further investigation is in progress at brisk pace. It is submitted on completion of investigation as expeditiously as possible, an appropriate final report under Section 173 Cr.P.C. will be filed by the investigating officer in the above case without any delay.
In view of the facts and circumstances states supra, there is no inaction in the matter of conducting investigation in Crime No.174 of 2016, as alleged in the writ petition. All other allegations of the petitioner against the respondent police authorities are incorrect, untenable and hereby denied.
Having regard to the contents of the written instructions, I deem it appropriate to dispose of the writ petition, by placing on record the said instructions furnished by the Inspector of
Police and the Station House Officer, Machavaram Police Station, Vijayawada City, dated 11.12.2018 with a further direction to the respondent - police to file final report as expeditiously as possible, in accordance with law. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
