HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.21454 OF 2002 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the third respondent in terminating the services of the petitioners with effect from 1.11.2002, as illegal and arbitrary and also to declare that the action of the respondents Nos.1 and 2 in not admitting the non-teaching posts, in which the petitioners are working since 1991, into grant-in-aid though they were duly selected and appointed after due process of selection in 1991 and though the 1st respondent recommended for release of grant-in-aid on 18.12.1998, as illegal and arbitrary. 2.

When this matter is taken up for hearing, the learned Counsel for the petitioners submitted that vide order dated 28.10.2002, this Court granted interim direction to the respondents to continue the petitioners in their respective posts by suspending the operation of the proceedings of the third respondent, and by virtue of the said interlocutory order, the petitioners are being continued in service and therefore, this writ petition can be disposed of. 3.

Recording the above submission, this Writ Petition is disposed of. If the petitioners are continuing their services, their cases shall be considered for absorption into grant-in-aid posts as

and when such vacancies arise, and as and when the respondents undertake such exercise to fill up the aided vacancies. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
