HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 44100 of 2018 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in seizing the tractor and trailer bearing Nos. TS 15EE 9431 and TS 15EE 9432 respectively of the petitioner, as illegal and violative of Articles 19(1)(g) and 21 of the Constitution of India. 2.

When the matter is taken up for hearing, the Government Pleader for Mines would submit that the seized vehicle was deposited before the Judicial Magistrate of First Class, Siddipet. 3.

Having regard to the above, the petitioner shall make an application before the concerned Court, as per the provisions of Cr.P.C. seeking release of the vehicle, after giving prior notice to the concerned Public Prosecutor, in which event the same shall be disposed of on the same day, in accordance with law. 4.
