This petition is filed, under Section 438 of the Criminal Procedure Code, seeking grant of anticipatory bail to the petitioner, who is A4, in Cr.No.664 of 2018 on the file of the Station House Officer, K.P.H.B Police Station, Cyberabad. The offences alleged are under Sections 420 and 406 of the Indian Penal Code and Section 5 of the APPDFEA.

Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that this petitioner is only a marketing executive of the company floated by A1 to A3 for promoting the concept of Karakkaya scheme and securing huge amount from the subscribers.

The confession of the co-accused is to the effect that this petitioner also shared the profits to an extent of Rs.25,00,000/ -. The contention of the counsel for the petitioner that the other accused were enlarged on bail, hence, cannot be considered for grant of anticipatory bail to the petitioner.

Hence, the criminal petition is dismissed. However, the Court below is directed to dispose of the bail application, if any, which would be filed by the petitioner, preferably, on the same day subject to pressure of other work. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
