HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.44094 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 2nd respondent in insisting the petitioner to vacate from a portion of his house and site property admeasuring 415 sq.yards situated at Door No.3-5-25, within the limits of Nidadavole Municipality for the purpose of formation of cement road, without following the procedure established under law, as illegal and arbitrary. By an order dated 13.12.2018, this Court directed the respondentauthorities not to interfere with the subject property except by following due process of law.

Learned Standing Counsel for the 2nd respondent-Municipality, on instructions, would contend that the Municipality has not laid the road and proposal to lay the road is adjacent to the drain and the said land does not belong to the petitioner.

In view of the submission made by the learned Standing Counsel for the 2nd respondent-Municipality, the writ petition is disposed of directing the 2nd respondent not to interfere with the subject property of the petitioner, except following the procedure established under law. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
