O R D E R
Aggrieved by the inaction of the 4th respondent - Tahsildar, in considering the application of the petitioner dated 20.12.2017 for issuing pattadar pass book and title deed in respect of the subject property, the present writ petition is filed.
Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue produced written instructions of 4th respondent dated 04.12.2018 stating that the claim of the petitioner is that she inherited the subject property from her husband by name Cherukuri Appaiah, who is stated to have died on 19.02.1996. There are objections from the second wife of the deceased husband of the petitioner by name Cherukuri Padma and also from the mother of the deceased husband of the petitioner by name Smt. Cherukuri Pichamma. Thus, there are civil disputes in the family members of husband of the petitioner and that soon after completion of enquiry, action will be initiated.
From the above facts and circumstances, it could be seen that the petitioner is stated to have made application as long back as on 20.12.2017 and the competent authority - 4th respondent instead of disposing of the same in accordance with law, kept it pending, and after filing of writ petition, filed written instructions, stating about the civil litigation in the family members of the deceased husband of the petitioner, and that action will be initiated soon after completion of enquiry. In view of the same, without expressing any opinion on merits,
writ petition is disposed of directing the 4th respondent to dispose of the above application of the petitioner in accordance with law, after issuing notice to the petitioner, unofficial respondent No.5, above mentioned objectors in the written instructions, and other effected parties, if any; within a period of two months from the date of receipt of a copy of this order and communicate the same to the parties. Interlocutory applications pending, if any, shall stand closed. No costs.
