THE HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD CRIMINAL REVISION CASE NO.3346 OF 2018 ORDER:

This revision is arising out of docket order, dated 26.11.2018 passed in Crl.M.P.No.576 of in Crl.M.P.No.538 of 2018 in Crl.App.No.962 of 2018 by the V Addl. District and Sessions Judge, Ranga Reddy District at L.B. Nagar.

The docket order, dated 26.11.2018 reads as under: "The petitioner/appellant filed Crl.M.P.No.538 of 2018 and as per the order therein, dated 12.11.2018 execution of the sentence passed in C.C.No.3 of 2016on the file of XXVI Metropolitan Magistrate, Cyberabad at Maheshwaram, Rangareddy District is ordered to be suspended on the condition of depositing of 5% of cheque amount within two weeks from the date of order and on the same terms and conditions imposed by the trial Court. As per the petitioner, he is a Senior citizen suffering from old age ailments and as such, he could not secure money within time granted and prays this Court for two weeks time to comply the said order.

In the result, this Criminal Miscellaneous Petition is partly allowed extending time for compliance till 06.12.2018 and no petition for further extension will be entertained."

The docket order passed by the trial Court is an interlocutory order. Therefore, the revision is not maintainable under Section 397 (2) Cr.P.C. However, the petitioner is given liberty to avail appropriate remedy available to him under law. 4.

With the above observation, the Criminal Revision Case is disposed of. Miscellaneous petitions, if any pending in this revision shall stand closed.
