HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.44431 of 2018 ORDER:
The grievance of the petitioners in this case is with regard to the provisional lists of eligible candidates for allotment of two bedroom-hall-kitchen houses by the Government of Telangana. The first provisional list was drawn up on 30.5.2017 and the second provisional list was drawn up on 27.9.2017.
It is the case of the petitioners that persons who are already holding houses and who are otherwise ineligible have also been included in the lists of provisionally eligible candidates. Significant to note, the petitioners did not even choose to approach the authorities by making a representation setting out the details, whereby the persons included in these provisional lists would be rendered ineligible. Without approaching the authorities in the first instance, it is not open to the petitioners to seek a writ of Mandamus straightaway. Unless the petitioners approach the authorities and there is inaction on the part of the authorities thereafter, a writ of Mandamus would not lie.
The Writ Petition is accordingly disposed of leaving it open to the petitioners to make a proper detailed representation to the authorities concerned setting out the grounds on which they allege that the names of persons included in the provisional lists dated 30.5.2017 and 27.9.2017 are liable to be deleted on the ground of their ineligibility.
