The case of the petitioner is that the second respondent issued preliminary notification under Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) proposing to acquire various lands of Aravayapalli revenue village and showing the name of the petitioner as possessor in respect of his land in Sy.No.79 to an extent of Ac.18.34 guntas, situated in Aravayapalli village, Kukkunuru Mandal, West Godavari District and showing Bhoodana Samithi as owner.

The petitioner filed objections/representation dated 31.07.2017 to the second respondent, but no action is taken and they have issued an endorsement dated 27.09.2017 and subsequently, on 17.10.2017 asking the petitioner to produce necessary documents for taking further action. It is the case of the petitioner that he has submitted all the relevant documents available with him, but the 3rd respondent is not passing any award. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Land Acquisition. The learned Assistant Government Pleader for Land Acquisition submitted that the petitioner was asked to submit necessary documents and there is no delay on the part of the third respondent in passing the award.

It is seen from the material placed on record that the petitioner has already filed documents even before the endorsement dated 27.09.2017. However, learned counsel for the petitioner submits that once again the petitioner will file the documents available with him.

In view of the above, the petitioner shall file necessary documents once again and the third respondent is directed to consider the objections of the petitioner along with necessary documents, if any, filed by the petitioner and pass award in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. No costs.

Consequently, Miscellaneous Petitions pending, if any, shall stand closed.
