This civil revision petition is filed purporting to challenge the order of attachment before judgment.

A perusal of the record shows that the order of attachment has not been filed. However, a mediators' report executing the warrant of attachment is filed in the revision petition. In my opinion, the civil revision petition is not maintainable without the order of attachment being filed. Moreover, learned counsel for the petitioners has submitted that seeking vacation of the order of attachment, his clients already filed an application and that the same is pending. When such application is pending, the petitioners are not entitled to invoke the supervisory jurisdiction of this Court under Article 227 of the Constitution of India for questioning the same order of attachment. 3.

In this view of the matter, the civil revision petition is dismissed, however, with liberty to the petitioners to pursue the application filed for vacation of the order of attachment.

As a sequel to dismissal of the civil revision petition, C.R.P.M.P.No. 8799 of 2017 shall stand dismissed as infructuous. Date: 08-12-2017.
