HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:

W.P.No.39458 of 2016 is filed alleging that 4th respondent is undertaking construction in deviation to the building permission granted to him and in spite of complaint filed, no action was taken by the respondent Corporation. This Court disposed of the said writ petition directing third respondent in the writ petition to consider the notice dated 30.08.2016 and the representation dated 07.11.2016, examine the grievance and take such course of action as warranted by law. Alleging said order is not complied, this Contempt Case is filed. 2.

In the counter-affidavit, third respondent stated that Builder has constructed three additional dwelling units on sixth floor (pent houses) and five shops in the stilt area in violation of sanctioned plan. However, no further action can be taken since Builder had filed O.S.Nos.2246 and 2268 of 2016 on the file of VI Additional Junior Civil Judge, City Civil Court, Hyderabad and obtained interim order in I.A.No.601 of 2016 in O.S.No.2246 of 2016.

In view of the same, it cannot be said that respondents have violated the directions of the Court warranting initiation of proceedings under the Contempt of Courts Act and Contempt Case is accordingly closed.

Miscellaneous petitions if any pending shall stand closed. No costs.
