HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.5200 OF 2002 ORDER:
This Writ Petition is filed seeking a writ of Mandamus declaring the Memo No.GM(P)/DS(Per)/AS(P)/PO.III-4/716/99-16, dated 24.08.2001, issued by the 3rd respondent as arbitrary, illegal and set-aside the same and consequently direct the respondents to give promotion to the petitioner as Junior Personal Officer on par with her juniors and similarly situated persons. 2.
Heard Sri M.Ratna Reddy, learned counsel, appearing for the petitioner, and Sri S.Ravindranath, learned Standing Counsel for the respondent - A.P. Transco.

It has been contended by learned counsel for the petitioner that the petitioner has relinquished her promotion, earlier, to the post of Junior Personal Officer but the respondents are treating it as permanent relinquishment and not considering her case, in the subsequent promotions. 4.
This Court, having considered the submission made by the petitioner and the material available on record, is of the considered view that the law on this subject is clear that a relinquishment for promotion should not be treated as a permanent relinquishment and, hence, the case of the petitioner should be considered in the future vacancies, if not already considered. 5.
Accordingly, the Writ Petition is disposed of directing the respondents to consider the case of the petitioner for future promotion, if not already considered. No costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed in consequence.
