HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.44246 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the respondents and in not considering the representation/complaint dated 31.07.2018, submitted by the petitioner seeking to take action against the illegal constructions made by the 4th respondent over the premises bearing H.No.2-3-703/B/2/16/1, Tirumala Nagar, Amberpet, Hyderabd, which is northern side of the property of the petitioner without maintaining any set backs touching to the property of the petitioner, as illegal and arbitrary. Learned counsel for the petitioner submits that though the petitioner submitted a representation to the respondents 2 and 3 on 31.07.2018, seeking to take action against the illegal constructions made by the 4th respondent over the subject premises, no action has been taken so far.
The learned Standing Counsel for the 2nd respondent, would submit that the respondent-authorities may be directed to pass appropriate orders on the representation of the petitioner, in accordance with law, at the earliest.
Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the respondents 2 and 3, to deal with the representation dated 31.07.2018, submitted by the petitioner seeking to take action against the illegal constructions made by the 4th respondent over the subject premises, and pass appropriate orders, in accordance with law as early as possible, preferably within a period of six to eight from the date of receipt of copy of this order by giving reasonable opportunity of hearing to the petitioner and all concerned. No order as to costs.
As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
