HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.44423 OF 2018 ORDER :
This writ petition is filed challenging the action of the respondents in not uploading 1-B register (ROR), Adangal Pahanies and all other record of rights in Andhra Pradesh Online Mee-Bhoomi Web Land Portal, in respect of the subject lands of the petitioners, pursuant to proceedings in Rc.NO.G2/215/2007, dated 06-02-2009 issued by the 2nd respondent and consequential proceedings in Rc.No.B/77/2009, dated 17.02.2009 and 17.06.2009, issued by the 4th respondent.
Learned Counsel for the petitioners submits that though the petitioners were allotted subject lands their names were not uploaded in 1-B Register and that they have also made several representations with regard to their grievance, but no action has been taken till date.
Learned Assistant Government Pleader for Revenue produced written instructions dated 17.12.2018 wherein it is stated that since the land granted to the writ petitioners on DK pattas is a government land in which the government has a vowed interest, the survey numbers with the extents assigned therein were listed out and were included in the Prohibitory list of immovable properties prepared under Section 22-A(1) of the Registration Act, 1908 and communicated to the Registration Department. It is also stated that it is a fact that as could be seen from the ROR Form-1 and 1B registers, the names of the
writ petitioners were mutated in Form-1 of Record of Rights against the relevant survey numbers of Allur Village but were not brought to Form-1B Register or to the Adangals for the reasons not known; and that consequently they were not uploaded into the revenue records in A.P.Online Mee-Bhoomi Webland Portal relating to the petitioners. He also submits that the petitioners have to make individual applications giving details.
In view of the above, the writ petition is disposed of granting liberty to the petitioners to make individual applications along with necessary documents showing that the land is allotted to them, to the 4th respondent and on such applications, the 4th respondent is directed to consider and take appropriate action, within a period of three months from the date of receipt of applications from the petitioners. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 20.12.2018 t k.
