Heard learned counsel for the petitioners, learned Government Pleader for Land Acquisition for respondents 1 and 2, learned Government pleader for Revenue for respondents 3 and 6, learned Government pleader for Panchayat Raj, for respondents 4 and 5 and learned Standing counsel for respondent No.7.

Petitioners claim that the respondents are constructing drainage across the petitioners' house sites on an extent of 138 Square yards each in Sy.No.483/2 of Vedurupaka Village, Rayavaram Mandal. Petitioners allege that steps are being taken without following the due process. If the property of petitioners is required for any public purpose, they have to follow the procedure as laid by the Act, 30 of 2013 and without doing that private properties cannot be used for public purpose. 3.

No material is placed on record to show that such steps are being taken by the Gram Panchayat or any other authority which offended the petitioners' rights without following the due process.

Learned Standing counsel, on instructions, submits that so far no steps are being taken to construct a drainage canal affecting the petitioners'

properties and it is only on apprehension, this writ petition is filed.

Recording the statement of learned Standing Counsel, the Writ Petition is dismissed. Pending miscellaneous petitions shall stand closed.
