HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.39567 of 2017 ORDER:

The petitioner prays for the following relief :- " ...... to issue an appropriate writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in not registering a crime against the named accused having received the complaint on 10-7-2017 is illegal, arbitrary, and contrary to the provisions of 154, 155, 157 of Cr.P.C. and also contrary to the settled principle of law laid down by the constitutional courts and consequently direct the respondents to register the crime on the named accused on the compliant of the petitioner...." .

The Assistant Government Pleader, on instructions, submits that the complaint dated 10.07.2017 is not received. Without getting into whether complaint was actually received but no acknowledgment is issued etc ., it is stated by the Assistant Government Pleader that if the complaint dated 10.07.2017 is re-submitted, the 4th respondent will make G.D. entry, enquire into the allegations and proc eed in ac cordance with law. The statement is placed on record.

The writ petition is disposed of by this order. (a) The petitioner is given liberty to re-submit copy of complaint dated 10.07.2017 to the 4th respondent by enclosing a copy of this order within four weeks from today.

(b) The 4th respondent, on receipt of complaint, is directed to make G.D. entry forthwith, enquire into the allegations made in the complaint and proceed in accordance with law. Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
