THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.44430 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material available on record.

In the present Writ Petition challenge is to the action of the respondents herein in opening and continuing rowdy sheet against the petitioner herein.

According to the learned counsel for the petitioner, the impugned action is illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India besides being opposed to the very spirit and object of the provisions of the Police Standing Orders, 601. It is submitted by the learned counsel that there is no conviction against the petitioner herein so far in any one of the cases registered against him and no crimes are pending against him.

On the other hand, it is submitted by the learned Government Pleader that, in order to have a watch on his movements, it has become incumbent on the part of the respondent-police authorities to continue rowdy sheet against the petitioner herein.

Having regard to the above facts and circumstances, Writ Petition is disposed of, permitting the petitioner herein to make an appropriate application/representation before the concerned authority, within a period of ten days from the date of receipt of

a copy of this order, and if any such application/representation is submitted by the petitioner herein, within the time stipulated above, the same be verified and appropriate action be taken/appropriate orders be passed, strictly in accordance with law, within a period of four weeks thereafter, in terms of the Police Standing Orders, 601. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
