Heard both sides.

By order in Crl.R.C.M.P.No.4872 of 2017 passed today, the revision petitioner is granted bail also.

The present Criminal Appeal No.300 of 2015 is preferred by the accused challenging the simple imprisonment for one year besides payment of compensation of Rs.10,00,000/- with default sentence of six months simple imprisonment passed by the Special Judicial Magistrate Court-II, Rahendranagar, Ranga Reddy District, which was dismissed by the order under challenge reflecting that it was dismissed for non payment of process. Therefore, it is just and reasonable to set aside the order under challenge, so as to decide appeal on merits rather than on technicalities of non-payment of process. Hence, the present Criminal Revision Case is allowed setting aside the order under challenge restoring the Criminal Appeal No.300 of 2015 to the file of III Additional Metropolitan Sessions Judge, Ranga Reddy District, L.B.Nagar, Hyderabad, subject to deposit of 1/4th of the compensation amount of Rs.10,00,000/- i.e., Rs.2,50,000/- within four weeks from today.
