HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.44461 of 2018 ORDER :

This writ petition is filed seeking a Writ of Mandamus declaring the action of respondents in not relieving the petitioner from KGBV Denkada Mandal to KGBV Poosapatirega Mandal, Vizianagaram for joining as a Cook, as arbitrary, illegal and contrary to the proceedings Rc.No.SSA-GCDOKGBV/27/2018-SA(4), dated Nil, November 2018 of 2nd respondent, and consequently direct the respondents to allow the petitioner to join as a Cook at KGBV Poosapatirega Mandal, Vizianagaram District.

Heard Sri A. Jagan, leaned counsel for petitioner and Sri G.Seena Kumar, learned Standing Counsel for the respondents. It has been contended by the petitioner that initially she was appointed as a Cook in Sarva Shiksha Abhiyan Centre at KGBV Denkada Mandal, Vizianagaram District in the year 2008 and the petitioner is discharging her duties under the control of 3rd respondent. The petitioner further contends that the 2nd respondent had issued transfer orders, transferring the petitioner from KGBV Denkada Mandal to KGBV Poosapatirega Mandal, vide proceedings dated Nil, November 2018. The grievance of the petitioner is that though the 2nd respondent had issued transfer orders transferring the petitioner from KGBV Denkada Mandal to KGBV Poosapatirega Mandal, the 3rd respondent is not relieving the petitioner and not allowing the petitioner to go and join in the transfer place and contend that appropriate orders be passed in this

AKS, J W.P.No.44461 of 2018 writ petition directing the 3rd respondent to relieve the petitioner in pursuance to the orders of transfer issued by the 2nd respondent. Learned Standing Counsel appearing for respondents contend that the 3rd respondent is bound to relieve the petitioner in terms of the transfer orders issued by the 2nd respondent, and therefore, contend that appropriate orders be passed.

This Court, having considered the rival submissions made by the parties, is of the considered view that this writ petition can be disposed of directing the 3rd respondent to relieve the petitioner in pursuance to the transfer orders issued by the 2nd respondent, within four weeks from the date of receipt of a copy of this order, so as to enable the petitioner to join at 4th respondent's office.

With these observations, the writ petition is disposed of. No order as to costs.
