THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.2546 OF 2017 ORDER:

This contempt case was filed alleging non-implementation of the order of this Court in W.P.No.27422 of 2017, dated 23.08.2017, along with other writ petitions.

This contempt case was admitted on 02.03.2018. Now a counter affidavit is filed by the contemnors stating that the writ petition was filed without submitting the application for licence and only after obtaining order from this Court, the petitioner submitted the required documents for renewal of licence on 11.10.2017. The counter affidavit further discloses that the licence was renewed on 05.01.2018. It is further stated in the counter affidavit that the petitioner obtained the order without clean hands and misused the process of this Court. The contemnors are present today and when the petitioner was asked to show the evidence of submission of the application before obtaining the order, he could not show the same. In the circumstances, the order of renewal passed by the contemnors on 05.01.

2018 shall be kept in abeyance subject to furnishing of proof of submission of the application before the date of order, i.e., 23.08.2017. If the petitioner submits the application before that date, the order of renewal can be restored. But, if there is no evidence of proof of submission of the application, the order of renewal can be implemented subject to the petitioner paying an amount of Rs.5,000/- to the credit of the Agricultural Market Committee, Guntur.
