ORAL ORDER:

Alleging that petitioner encroached pathway, Gram Panchayat issued notice on 23.11.2018 to explain whether any rights vests in her to occupy the pathway. According to petitioner, she submitted explanation dated 27.11.2018 sent through registered post and alleges that without considering the said explanation, respondents are taking coercive steps compelling the petitioner to come before this Court. 2.

In the writ petition, petitioner challenges the notice dated 23.11.2018. It is not the case of the petitioner that Panchayat Secretary of the Gram Panchayat is not competent to issue such notice and apparently petitioner filed her explanation to the show cause notice but so far no decision is made. Court is not inclined to entertain the writ petition at this stage. Writ petition is disposed of directing the respondents to consider the representation of the petitioner dated 27.11.2018, if the same is already received and pass appropriate orders as warranted by law before taking any coercive action against petitioner. No costs.
