Heard learned counsel for petitioner and learned Government Pleader for Revenue.

Petitioner claims to be owner of land to an extent of Ac.4.92 cents in R.S No. 40/1 and Ac.4.81 cents in R S No. 35/2, Rammannagudem, Dwaraka Tirumala mandal, West Godavari.

It appears there is interse dispute between petitioner and other private persons and petitioner was unsuccessful before the trial Court. Against the judgment and decree passed by the trial Court, petitioner preferred appeals in A.S. Nos. 8 and 9 of 2016 pending on the file of II Additional District Judge, Eluru, West Godavari district. This writ petition is filed alleging that the respondent company is trying to provide power supply connection to third parties in the property belonging to petitioner and even though petitioner filed objections the same were not considered and in the event of granting power supply to third parties, grave prejudice would be caused to petitioner.

Persons against whom petitioner alleges of obtaining power supply connection in his land are not made parties to this writ petition, though their names are mentioned in the representation filed by petitioner. As per the averments made in the affidavit filed along with writ petition and submissions made by learned counsel for petitioner, it is clear that as of now power supply connection is not provided by respondents. Petitioner is seeking a direction to respondent company not to provide power supply if an application is made for grant of power supply over the subject property, which action is premature. Writ petition is dismissed leaving it open to the petitioner to avail remedies

open to him as and when cause of action arises. No costs. Miscellaneous petitions, if any pending, are closed.
