- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.44567 OF 2018 ORDER :
Heard learned counsel for the petitioner, learned Government Pleader for Panchayat Raj for respondents 1, 2 and 4 and Sri G.Narender Reddy, learned Standing counsel for respondent No.3.
2.
Under the Aasara Pension Scheme, pension was granted to the petitioner earlier. However, as it has come to the notice of the competent authority that petitioner is shown as beneficiary of health card issued to the daughter of petitioner bearing I.D.No.2040045, the pension was withdrawn. On 30.04.2016 petitioner claims to have submitted a representation stating that he is no more dependant on his daughter; that his daughter is not living with him; that he has not availed the benefit of health card and therefore, sought for restoration of Aasara Pension. 3.
There is no material placed on record to show that such representation was acknowledged by the respondents. However, as of now also there is no clarification whether any new health card was issued to petitioner's daughter and in the new health card, name of the petitioner is not reflected as a beneficiary. 4.
At this stage, learned counsel for the petitioner seeks leave of the Court to make fresh representation enclosing all the relevant documents in support of his claim and to request for sanction of pension under the Aasara Pension Scheme.
- 3 - 5.
Having regard to the same, liberty is granted to the petitioner to make a fresh representation to the competent authority by enclosing all the relevant documents. If such a representation is made, the competent authority shall consider and take a decision on the eligibility of the petitioner to grant pension under the Aasara Pension Scheme and pass appropriate orders, as warranted by law, within six (6) weeks from the date of receipt of such representation.
6.
With the above directions, the Writ Petition is disposed of. Pending miscellaneous petitions shall stand closed. __________________ P.NAVEEN RAO,J 10th December, 2018 Rds
