- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.3292 OF 2018 ORDER :

This contempt case is filed alleging willful violation of the order of this Court in I.A.No.1 of 2018 in W.P.No.29392 of 2018. 2.

On 21.08.2018, this Court passed the following order : "Notice before admission returnable in four (4) weeks, only with reference to the issue of not proceeding against other employees, who are also alleged to be responsible and who are higher in rank than the petitioner i.e., Panchayat Secretary and Sarpanch of Gram Panchayat, who are arrayed as respondents 5 and 6. Post after four (4) weeks.

Pendency of the Writ Petition does not come in the way of considering the explanation offered by petitioner to the show cause notice dated 21.05.2018 and taking appropriate decision as warranted by law by assigning reasons after due consideration of the explanation of the petitioner."

Alleging that violating the said direction, the 2nd show cause notice is issued without considering the explanation offered by the petitioner, this contempt is filed. Whether the 2nd show cause notice is valid or not cannot be gone into at this stage. There was no direction issued by this Court to take any decision or to pass any order. It was only an observation made, granting liberty to them to proceed further consequent to the show cause notice dated 21.05.2018.

Thus, the contempt proceedings are not maintainable. Accordingly, the Contempt Case is dismissed. It is always open to the petitioner to work out his remedies, if aggrieved by the 2nd show cause notice. Pending miscellaneous petitions shall stand closed.
