THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 44602 OF 2018 O R D E R :

This writ petition is filed challenging the action of the respondents 1 to 4 in disconnecting the power supply to M/s.Dhanalakshmi Rice Mill, bearing SC No.0501411199, Narketpally on the request of 5th respondent without issuing anynotice to the possessor of the service connection, particularly in the light of civil dispute pending in OS.No.307 of 2015. Learned counsel for the petitioner submits that without issuing any notice to the petitioner, power connection has been disconnected.

This Court on 06.12.2018, granted interim order which reads as follows;

"Apparently, power supply is disconnected to Sri Dhanalaxmi Rice Mill bearing Service Connection No.0501401199, Narketpally, without notice to the petitioner.

Hence, interim direction as prayed for. However, this order does not come in the way of the respondents taking action by following the due process."

Learned counsel for the Vacate stay petitioner/5th respondent submits that the service connection is in the name of

5th respondent; that basing on the letter of the 5th respondent, the respondents disconnected the power supply to the service connection for which the petitioner cannot have any objection; and that if petitioner wants any service connection he can make application. He also complains that no action has been taken by the respondents, as on today, inspite of granting liberty in the interim order to the respondents to take action by following due process of law.

Heard learned Standing Counsel for respondents 2 to 4 who submits that by virtue of interim order dt.06.12.2018, already power connection is restored to the petitioner, but, as per the observation made in the interim order the respondents are taking action.

It is to be seen that the only grievance of the petitioner is that without any notice the service connection has been disconnected. In the interim order granted by this Court on 06.12.2018, there is a direction to the respondents to take action by following due process.

In view of the aforesaid facts and circumstances, the competent authority is directed to issue notice to the petitioner as well as 5th respondent and there after take appropriate action in

accordance with law within a period of four weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. __________________________ A.RAJASHEKER REDDY, J 01.08.2019 t k.
