HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.44593 OF 2018 ORDER :

This writ petition is filed challenging the action of the 4th respondent in taking steps to destroy the banana crop in the land of petitioner to an extent of Ac.5.00 cents in R.S.No.107/1, situated at Kommanavaripalli Village, Pullampet Mandal, YSR Kadapa District, with the help of the 5th respondent. Learned counsel for the petitioner submits that they have not received notice under Section of the A.P.Land Encroachment Act, 1905.

Whereas, learned Assistant Government Pleader for Revenue states that the said notice was returned by the postal department with an endorsement 'insufficient address'.

In view of the above, it is open for the 4th respondent, now, to serve a copy of the notice under Section 7 of the Act to the petitioner and the petitioner is to receive the same from the 4th respondent. Further, it is open for the petitioner to avail alternate remedy as may be available to him under law. With the above observation, the writ petition is disposed of. No order as to costs.
