HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.44657 of 2018 ORDER:

This writ petition is filed challenging the action of the respondents in not considering the requests/representations for allotment of alternate lands by the petitioners, who displaced from the land in Survey Nos.4231/2 of Alluru Village and Mandal, SPSR Nellore District, by the respondents for constructions of summer storage tank by considering orders of this Court in WP.No.5717/2011, dated 02.06.2015, though similarly situated persons were allotted alternate sites. Learned Assistant Government Pleader for Revenue produced written instructions stating that petitioner's case cannot be considered.

Learned counsel for the petitioners states that petitioners' representation is pending.

In this case it is to be seen that the competent authority, instead of keeping the representation of the petitioner pending, could have passed an order on the same and communicated the same to the petitioner enabling him to challenge the same. In view of the same, the competent authority is directed to dispose of the representations of the petitioners, if they are eligible, in accordance with law and communicate the same to

the petitioners, within a period of three months from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.
