HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.44706 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents 2 to 8 in not taking any legal action against the 9th respondent, on the complaints dated 23.01.2018, 29.10.2018 and 29.11.2018, made by the petitioners for the illegal constructions made by the 9th respondent, in the house D.No.14-7-9, Chevitigantivari Street, Morrispet, Tenali, Guntur District, without obtaining any permission from the competent authority, as illegal and arbitrary. Though various grounds are raised, learned counsel for the petitioner submits that the 9th respondent is making illegal constructions in the subject premises without obtaining any permission from the concerned Municipal Corporation. He further submits that though the petitioner submitted the complaints dated 23.01.2018, 29.10.2018 and 29.11.

2018, bringing the fact of illegal constructions of the 9th respondent, in the subject premises, no action has been taken so far. The learned Standing Counsel for the Municipality, would submit that the respondent-authorities, may be directed to pass appropriate orders on the representations/complaints of the petitioner, in accordance with law, at the earliest.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the respondent-authorities, to deal with the complaints/representation dated 29.11.2018, made by the petitioners seeking to take action against the 9th respondent for his illegal constructions in the subject premises and pass appropriate orders, in accordance with law as early as possible, preferably within a period of three to six months from the date of receipt of copy of this order by giving reasonable opportunity of hearing to the petitioner and all concerned. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
