ORDER
This writ petition is filed seeking to issue a Writ of Certiorari calling for the records relating to and connected with the Award dated 26-02-2001 passed in I.D.No.18 of 1998 by the Labour Court-II, Hyderabad, and quash or set aside the same by holding it as arbitrary and illegal. Heard Sri K.Harinath, learned Standing Counsel appearing for the petitioner-Corporation and learned Government Pleader appearing for the 2nd respondent. When the matter is taken up for hearing, it is reported by the learned Standing Counsel appearing for the petitionerCorporation that the 1st respondent-workman had retired from service on attaining the age of superannuation and the retirement benefits have been paid to the respondentworkman. In view of the same, the cause in the writ petition does not survive for adjudication. Even on merits, the Labour Court had passed the impugned Award setting aside the removal order on proportionality theory. When the Labour Court had exercised its power under Section 11-A of the Industrial Disputes Act, 1947, unless and until a grave irregularity has
been pointed out, the findings of the Labour Court cannot be reversed. There are no merits in this writ petition and the same is liable to be set aside.
Accordingly, the Writ Petition is dismissed. No costs. Miscellaneous petitions, if any, pending shall stand closed.
