ORDER

This writ petition is filed seeking to declare the impugned proceedings dated 28.10.2017 issued by the 3rd respondent, as arbitrary and illegal.

The petitioner is a licensed and registered contractor of APEPDCL. Since 15 years, he is doing spot billing works in Eluru. While so, the 3rd respondent issued E-Procurement Tender Notice dated 21.09.2017 for the work of carrying out continuous monthly spot billing work on contract basis in Municipalities/Mandal Head Quarters/Rural/Agency Areas of Eluru Circle for a period of one year i.e., from 1.11.2017 to 31.10.2018. Pursuant to the same, the petitioner, 6th respondent and other registered contractors have participated. The 3rd respondent vide proceedings dated 28.10.2017 awarded the said contract in favour of the 6th respondent. The grievance of the petitioner is that though the 6th respondent quoted higher bid amount than him, the 3rd respondent awarded the contract to the 6th respondent.

Learned Standing Counsel appearing for the respondents submits that the petitioner is registered as Class-II Contractor and he can execute the work upto Rs.5,00,000/-, whereas the 6th respondent is registered as a Class-I contractor and he can execute the work above Rs.5,00,000/- and the

estimated cost of the work is Rs.36,21,000/-, which is not disputed by learned counsel for petitioner.

In view of the same, the petitioner cannot have any grievance as he is a class-II contractor and he can execute the works upto Rs.5,00,000/-. This Court is of the view that there are no merits in this writ petition.
