HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRL.P.No.12774 OF 2017 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the look out circular dated 31.07.2014 issued against the petitioner.

The petitioner is A1 in the calendar case for the offence punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. The petitioner is at Singapore. Respondent No.4 filed complaint making serious allegations of harassment against the petitioner for her failure to meet illegal demand of dowry. Thereupon, the Magistrate has referred the said complaint to the police for investigation and the police registered the case as Crime No.114 of 2014. After investigation, the investigating agency filed charge sheet before the Magistrate. The petitioner appeared before the Magistrate through counsel and when the mater was posted for examination, the petitioner was absent and thereupon, the Magistrate ordered NBW, which was recalled on the application filed by the petitioner on 20.12.2017, but the look out circular was pending since 2014.

During hearing, learned counsel for the petitioner fairly conceded that the petitioner intends to come down to India to appear before the Court on 05.01.2018 to co-operate with the Court for disposal of the matter.

In view of the undertaking given by the petitioner through counsel, the look out circular is kept abeyance till

15.01.2018 and in case the petitioner appears before the Court on 05.01.2018, the look out circular is deemed to have been cancelled, otherwise, the authorities concerned can proceed in accordance with law based on such look out circular. With the above direction, the criminal petition is disposed of.

Pending miscellaneous petitions in the petition, if any, shall stand closed.
