THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.44736 of 2018 ORDER:
Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material available on record.
When the matter is taken up, written instructions, dated 10.12.2018, furnished by the Sub Inspector of Police, Sircilla Police Station, Rajanna Sircilla District, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, are as under:
"The petitioner herein has lodged complaints dated 5.2.2018 and 18.6.2018 with the Police of Sircilla Police Station stating that one Mr.T.V.Laxman Rao, J.Mohan Rao and MadasBalaramulu @ Balaram with ill motive and with dishonest intention are encroaching and threatening the members of the Telangana State Government Retired Employees Association, Rajanna Sircilla District Branch including him and trying to interfere with lawful activities of the members of the petitioner's Association and they conspired together and entered into a criminal conspiracy in order to defraud the association by inducing the Scheduled Caste Retired Employees to take over the Association premises from legally and validly elected members of the Association as is evident from the letter of Telangana Sate Government Retired Employees Assoc1aton.
Upon receipt of the said complaints, necessary entries were made into the Station General Diary. Since the dispute of the petitioner's Association as well as the unofficial respondents herein is purely internal with regard to their lawful activities of their
AVSS,J W.P.No.44736 of 2018 Association and mainly civil in nature and hence no action was taken on the complaints except advising the petitioner to approach the competent court of law for his grievance.
To that effect, a notice dated 10.12.2018 was also issued to the petitioner herein and obtained acknowledgment from him. A copy of the notice is annexed to this written instructions for the kind perusal of this Hon'ble Court.
It t is pertinent to submit that both parties are claiming rights of their association and hence no action was taken by this respondent police except sending notice to the petitioner to settle their dispute in a competent court of law.
It is humbly submitted that the petitioner is unnecessarily trying to involve the respondent police into his personal and civil disputes".
Eventually a request is made by the learned counsel for the petitioner to dispose of the Writ Petition by placing on record the above instructions.
Accordingly, by placing on record the above written instructions, this Writ Petition is disposed of. However, it is open for the petitioner herein to avail the other remedies in accordance with law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
