HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No. 3369 of 2018 ORDER:

This Contempt Case is filed alleging violation of the order dated 01.10.2018 passed by this Court in I.A.No.1 of 2018 in W.P.No.35073 of 2018, wherein and whereby this Court passed the following order:

" In view of the same, there shall be interim direction to the Convener, Language Pandit Training Common Entrance Test, 2018, office of Director of School Education, Telangana, Hyderabad, to conduct counseling in respect of colleges having affiliation, within a period of four weeks from the date of receipt of a copy of this order."

A counter affidavit is filed stating that no college is having affiliation as such the counseling could not be conducted. But the learned counsel for the petitioners submits that earlier even without affiliation counseling was done and the colleges have also paid the affiliation fees and the same is pending with the Government as such, the respondents cannot take such plea and withhold the counseling.

Heard Sri Ch.Jagannatha Rao, learned counsel for the petitioner, Government Pleader for School Education (TG) and Sri K.Ramakanth Reddy, learned Standing Counsel for NCTE. Though reply affidavit is filed the fact that the colleges did not have affiliation is not disputed by the learned counsel for the petitioners.

In view of the above, the justification shown by the respondents for not conducting counseling has to be accepted and I see no violation of the orders passed by this Court. The contentions raised by the learned counsel for the petitioners may hold good while disposing of the Writ Petition, but this Court cannot go into the said contentions and grant further directions in this contempt case. Hence, the Contempt Case is closed, giving liberty to the petitioners to raise all their contentions in the writ petition.

Consequently, miscellaneous petitions, if any, pending shall stand closed.
