HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT W.P.No.6458 OF 2002 ORDER: (Per the Hon'ble Sri Justice S.V.Bhatt) Heard learned Senior Counsel Sri R.Raghunandan Rao for the petitioner and Sri P.Keshava Rao, learned Standing Counsel for GHMC/respondents. The petitioner prays for Certiorari to call for the records relating to and inclusive of proceedings of the 2nd respondent bearing Lr.No.51/TC2/MCH/2002 dated 27.03.2002 and quash the same.
Learned counsel for the petitioner submits that through the impugned demand, the respondents have called upon the petitioner to pay property tax levied by the respondents.
The further objection is that the property tax cannot be recovered from a party beyond three years of alleged due date.
Learned Senior Counsel alternatively submits that the petitioner would be satisfied if the petitioner is given liberty to file representation before the respondents on the grievance canvassed in this writ petition and the respondents can be directed to consider and dispose of the same. Learned Standing Counsel requests the Court to stipulate some reasonable time for disposing of the representation. The petitioner is given liberty to represent to the respondents against the levy and demand of property tax either for the periods covered in the writ petition or anterior thereto within four weeks from today by enclosing a copy of this order and if such representation is made, the respondents are directed to consider and pass appropriate orders in accordance with law.
