This Transfer Civil Miscellaneous Petition, under Section 24 of the Code of Civil Procedure, 1908 (CPC), is filed by the petitioners seeking to withdraw O.P.No.98 of 2016 from the file of XXIV Additional Chief Judge, City Civil Court, Hyderabad, and transfer the same to the file of District Judge, Motor Accidents Claims Tribunal (MACT), Karimnagar.

Heard the learned counsel for both sides and perused the record.

In the course of submissions, it is brought to the notice of this Court that earlier respondent Nos.1 to 4 herein filed Tr.O.P.No.2207 of 2017 before the Chief Judge, City Civil Court, Hyderabad, seeking to transfer the very same O.P.No.98 of 2016 from the file of XXIV Additional Chief Judge, Hyderabad, to any other Court. The learned Chief Judge, City Civil Court, Hyderabad, passed an order withdrawing the afore-said O.P., from the file of XXIV Additional Chief Judge, Hyderabad, and transferring the same to the file of I Additional Chief Judge, City Civil Court, Secunderabad, and the O.P No.98 of 2016 was renumbered as O.P.No.97 of 2019. Since O.P.No.98 of 2016 was transferred to the file of I Additional Chief Judge, City Civil Court, Secunderabad, and re-numbered as O.P.No.97 of 2019, the petitioners filed Tr.C.M.P.No.128 of 2019 before this Court to withdraw O.P.No.97 of 2019 from the file of I Additional Chief

Judge, City Civil Court, Secunderabad, and transfer the same to the file of District Judge, MACT, Karimnagar. 4.

When this Court pointed out about filing of two Tr.C.M.Ps seeking transfer of same O.P, learned counsel for the petitioners seeks permission of this Court to withdraw the present Tr.C.M.P.No.878 of 2017.

In view of the same, permission is accorded and accordingly, the present Transfer Civil Miscellaneous Petition is dismissed as withdrawn. There shall be no order as to costs.
