This writ petition is filed challenging the action of respondents 3 and 4 in entertaining the application of 5th respondent for mutation of land in his favour to an extent of Ac.3.14 guntas in Sy.No.44/1/E, an extent fo Ac.1.38 guntas in Sy.No.46/E, and extent of Ac.0.1 1⁄2 guntas in Sy.No.89/1/E and an extent of 0.14 guntas in Sy.No.90/1/E, situated at Thammadapalli, Bachannapet Mandal, Warangal District, and for issuance of pattadar pass books and title deeds, pending OS.No.242/2010 and OS.No.88/2018 on the file of Prl.Junior Civil Judge, Janagaon.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.
Admittedly, civil suits are pending between the petitioner and 5th respondent.
If petitioner has any apprehension that 5th respondent will dispose of the subject property, it is open for the petitioner to seek appropriate orders in the civil suit pending between him and 5th respondent. In view of the same, this Court is not inclined to entertain the writ petition.
Accordingly, the writ petition is disposed of granting liberty to the petitioner to obtain appropriate orders in the civil suit pending between petitioner and 5th respondent. If 5th
respondent filed any application for mutation of his name in his favour in respect of the subject land, it is open for the petitioner to file objections before the competent authority in respect of the same and on such objections, the competent authority is directed to consider the same before mutating the subject property in favour of 5th respondent. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the Writ Petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 11.12.2018 tk
