THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO TRANSFER C.M.P. NO.817 OF 2018 ORDER:

This Transfer CMP is filed to withdraw the O.P. No.1297 of 2017 on the file of Judge, Additional Family Court, City Civil Court, Hyderabad and transfer it to the Judge, Family Court, Secunderabad where O.P. No.733 of 2018 is pending.

The petitioner is the husband of the respondent and the respondent had filed O.P. No.1297 of 2017 against the petitioner before the Family Court, Hyderabad for dissolution of their marriage. The petitioner had filed FCOP No.1768 of 2017 before the Family Court, Ranga Reddy District also seeking dissolution of the marriage. In Transfer CMP No.738 of 2017 on 16.11.2017, this court transferred FCOP No.1768 of 2017 from the Family Court, Ranga Reddy District to the Family Court, Secunderabad. After such transfer, it is numbered as O.P. No.733 of 2018 in the Family Court, Secunderabad.

In this Transfer CMP, the petitioner seeks clubbing of both the matters and joint trial by the Family Court, Secunderabad to avoid inconsistent judgments. Counsel for the respondent states that in O.P. No.1297 of 2017 for reconciliation was done and it failed and issues have already been framed.

Be that as it may, to avoid conflicting judgments in both the O.Ps, this Transfer CMP is allowed; O.P. No.1297 of 2017 on the file of Judge, Additional Family Court, Hyderabad is transferred to court

of the Judge, Family Court, Secunderabad to be tried along with O.P. No.733 of 2018 on the file of the said Court. No costs. Miscellaneous petitions, pending, if any shall stand closed. __________________________________ M.S. RAMACHANDRA RAO, J Date: 03.07.2019 MRKR
