The Hon'ble Dr.Justice Shameem Akther Criminal Petition No.11931 of 2017 Order:

This Criminal Petition, under Section 438 of Cr.P.C., is filed by the petitioners/accused Nos.1 to 6, seeking anticipatory bail in the event of their arrest in connection with Crime No.286 of 2017, on the file of Suryapet II Town Police Station, Suryapet District, registered for the offences punishable under Sections 420, 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. Heard the learned Counsel for the petitioners, learned Additional Public Prosecutor appearing for the respondent- State and perused the record.

The marriage between the petitioner/accused No.1 and the defacto complainant took place on 06-05-2017 at Suryapet. It is brought to the notice of this Court that the defacto complainant resided with the petitioner/accused No.1 for five days at Khammam and thereafter, some differences arose between the parties.

In these facts and circumstances, it is appropriate to pass an order in terms of the directions given in Rajesh Sharma and others vs. State of U.P. and another1.

Accordingly, relying upon the latest two-Judge Bench expression of the Apex Court, dated 27-07-2017, in Crl.A.No.1265 1 2017 (2) ALT (Crl.) 393 (SC)

Dr.SA, J Crl.P.No.11931 of 2017 Dt: 12-12-2017 of 2017 (SLP (Crl.) No.2013 of 2017) in Rajesh Sharma Supra, the matter is directed to be referred by the learned jurisdictional Magistrate to the Committee to be constituted for reconciliation and settlement and in a contra situation, to proceed with the subject matter of crime on merits. During the negotiations before the Committee so constituted, the petitioners/accused Nos.1 to 6 shall not be arrested.
