HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.44786 of 2018 ORDER:

1) Heard learned counsel for the petitioner and Sri M.Balaji, Standing Counsel appearing for the second respondent. With the consent of both the parties, the writ petition is taken up for disposal at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in interfering with the petitioner's land in Sy.No.463/ 2 of Gunadala, Vijayawada and proposing to lay road from Gurunanak Colony Road to Mahanadu Road, without following due process of law and without paying any compensation as illegal and arbitrary.

3) Though various grounds are raised learned counsel for the petitioners restricts his prayer seeking a direction to the respondents to follow due process of law.

4) Having regard to the facts and circumstances of the case and without going into the merits of the case, the present writ petition is disposed of, directing the respondents not to interfere with the subject property except in

accordance with the due procedure laid down by law. There shall be no order as to costs.

5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
