HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos.44793, 44843 and 44852 of 2018 COMMON ORDER:

These writ petitions are filed challenging the action of the respondents 3 and 4 and their subordinates in interfering with construction work of the building which is carrying out by the petitioners with valid construction permission over Plots bearing No.A-83, admeasuring 270 Sq.yards, Sy.No.20, Plot No.43, admeasuring 180 sq.yards, Sy.Nos.18/A to 18/UU, Plot bearing No.D28, admeasuring 330 sq.yards, Sy.Nos.18/A to 18/UU, respectively, situated at Hayat County, Mallapur Village, Balapur Mandal, Ranga Reddy District, without issuing any prior notice to the petitioners and without following due procedure of law.

Heard learned counsel for the petitioners.

Learned Assistant Government Pleader for Revenue submits that they are not interfering with the possession of the petitioners and that the subject property is a private property.

Sri N.Praveen Kumar, Learned Standing Counsel for 4th respondent submits that they are not interfering with the possession of the petitioners; and that if they find any deviations they will take action in accordance with law.

In view of the aforesaid facts and circumstances, these writ petitions are disposed of directing the respondents not to interfere with the construction of the petitioners over subject land, if the same is as per the permission granted by the 4th respondent. However, if any deviations are found in respect of subject constructions, it is open for the 4th respondent to take action by following due process of law. No order as to costs.
